Kommunen har plikt til å tilby nødvendige helse- og omsorgstjenester, tjenester etter opplæringsloven og barnehageloven. Hva barnet og familien har rett på, avgjøres etter en individuell vurdering. I Norge har vi 357 kommuner og dessverre praktiseres helse- og omsorgstjenester, og opplæringstilbud svært ulikt i kommunene.

It is problematic to ensure equality for all citizens when the municipalities choose to interpret the legislation differently. It is not equal or equal that children with functional variations receive good offers and services in one municipality, while children in the neighboring municipality receive significantly worse services, or none at all. Admittedly, this is not only due to misinterpretation of legislation, but also a lack of knowledge and competence, and poor attitudes towards people with functional variations.

Many municipalities have the idea that it is enough to provide the minimum, rather than ensuring people a full service offer. "Parental response" and "reasonableness" are often used as arguments for providing inadequate services or refusal. Abuse of power and threats about child protection are also not unusual practices by municipalities towards parents of children with great care and care needs.

Vedtak og Klage

Når en søker om helse- og omsorgstjenester eller mottar svar på tilrettelagt opplæring eller spesialpedagogisk hjelp i barnehagen, så skal svaret gis via enkeltvedtak. Her følger klagerettigheter. Desverre så må det gjerne klages på vedtaket for å få et forsvarlig tilbud.
